Welcome to TerraTune’s 2025 Free Alpha (“Service”), operated by Rakurs Tech LLP (“we,” “us,” or “our”). By accessing or using terratune.io or our web app, you agree to these Terms of Use (“Terms”). If you do not agree, please do not use the Service.

1. Eligibility

The Service is available to users 18 or older. By using the Service, you confirm you meet this requirement and will use the Service only for non-commercial purposes as defined below.

2. Free Alpha Access

The Service is offered free during the 2025 Free Alpha phase for testing purposes, such as evaluating variable rate seeding optimization for personal, academic, or scientific use. Access is “as is,” with no guarantees of availability, functionality, or support. We may modify or discontinue the Service at any time without notice.

3. Non-Commercial Use

The Service incorporates data and functionality from Google Earth Engine (“GEE”), which is subject to GEE’s non-commercial use terms. You agree to:
– Use the Service solely for non-commercial purposes, such as personal farm management, research, or education.
– Not use the Service to generate revenue, provide commercial services, or engage in any for-profit activities.
– Comply with Google’s GEE terms (available at https://earthengine.google.com/terms/).

4. User Conduct

You agree to:
– Use the Service lawfully and for its intended non-commercial purpose.
– Not upload harmful code, violate others’ rights, or disrupt the Service.
– Provide accurate information when using the Service.
– Not share, sell, or redistribute GEE data or outputs from the Service for commercial purposes.

5. Intellectual Property

All content, code, and designs in the Service, including GEE-derived outputs, are owned by us, our licensors, or Google (for GEE data). You may use the Service for personal, non-commercial purposes during the alpha phase. You may not copy, modify, distribute, or commercially exploit any part of the Service or GEE data without our written permission and compliance with GEE’s terms.

6. Data and Feedback

User Data: You retain ownership of data you upload (e.g., farm or crop data). You grant us a non-exclusive, worldwide, royalty-free license to use, store, and process this data to provide and improve the Service, solely for non-commercial purposes.
GEE Data: Any GEE data accessed via the Service remains subject to Google’s non-commercial license. You may not use GEE data for commercial purposes or redistribute it outside the Service.
Feedback: Any feedback you provide about the Service may be used by us without compensation or restriction, provided it complies with non-commercial use.

7. No Warranty

The Service, including GEE data, is provided “as is” without warranties of any kind, express or implied. We do not guarantee accuracy, reliability, or fitness for a particular purpose. Use is at your own risk, and you acknowledge GEE data may have limitations or errors.

8. Limitation of Liability

To the fullest extent permitted by law, we and our licensors (including Google) are not liable for any damages (direct, indirect, incidental, or consequential) arising from your use of the Service, including data loss, financial loss, or equipment damage.

9. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms or GEE’s non-commercial terms.

10. Governing Law

These Terms are governed by the laws of Kazakhstan. Any disputes will be resolved in the courts of Almaty, Kazakhstan.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance.
